Privacy Policy
1. Information We Collect
Kyn Technology Pte Ltd ("KYN", "we", "us") collects information in the following ways when you use our website at kyn.com.sg or engage our services:
Information you provide directly
- Name, business name, email address, and phone number submitted through contact forms or WhatsApp.
- Project briefs, workflow descriptions, and other business information shared during discovery calls or onboarding.
Information collected automatically
- Browser type, device type, operating system, IP address, and pages visited (via server logs and analytics tools).
- Referral source and on-site engagement data (scroll depth, clicks) used to improve the website.
Information from third-party integrations
Where you grant access to third-party platforms (e.g. HubSpot, Google Workspace, WhatsApp Business) as part of a project engagement, we process only the data necessary to deliver the agreed deliverables.
2. How We Use Your Information
We use collected information to:
- Respond to enquiries and provide quotations.
- Deliver, maintain, and improve the software systems and AI workflows we build for you.
- Send project-related communications (status updates, handover documents, maintenance reports).
- Improve our website and marketing based on aggregate, anonymised analytics.
- Comply with applicable Singapore law, including the Personal Data Protection Act 2012 (PDPA).
We do not sell, rent, or trade your personal data to any third party for their own marketing purposes.
3. Disclosure of Information
We may share your information with:
- Sub-contractors and technology partners engaged to deliver project work, bound by equivalent confidentiality obligations.
- Cloud infrastructure providers (e.g. Vercel, AWS, Supabase) that host systems we build on your behalf.
- Government or regulatory authorities where required by Singapore law or court order.
We require all third parties handling personal data to implement appropriate technical and organisational safeguards.
4. Data Retention
We retain personal data only for as long as necessary to fulfil the purposes for which it was collected, or as required by law. Project-related data is typically retained for seven years for accounting and contractual purposes. You may request deletion of your personal data at any time by contacting us (see Section 8).
5. Security
We implement industry-standard technical and organisational measures to protect your information against unauthorised access, loss, or misuse, including encrypted communications (HTTPS), access controls, and regular security reviews. No system is completely secure; we cannot guarantee absolute security of data transmitted over the internet.
6. Cookies & Tracking
Our website uses minimal cookies: a session cookie for theme preference (light/dark mode) stored in localStorage, and standard server access logs. We do not use advertising cookies or cross-site tracking. Third-party analytics, if enabled, may set their own cookies subject to their own privacy policies.
7. Third-Party Services
Our website links to or integrates with third-party platforms (WhatsApp, Google, HubSpot). We are not responsible for the privacy practices of those services. We encourage you to read their respective privacy policies before submitting information to them.
8. Your Rights (PDPA)
Under Singapore's Personal Data Protection Act 2012, you have the right to:
- Request access to the personal data we hold about you.
- Request correction of inaccurate or incomplete personal data.
- Withdraw consent to the collection, use, or disclosure of your personal data (subject to legal or contractual restrictions).

Part B
Terms of Service
1. Services & Engagement
These Terms of Service govern the relationship between Kyn Technology Pte Ltd ("KYN") and any individual or entity ("Client") that engages KYN for consulting, software development, or AI workflow services.
Scope of Work
All engagements are governed by a written Scope of Work ("SOW") or project agreement agreed between KYN and the Client before work commences. The SOW specifies deliverables, timelines, fees, and any specific terms applicable to that project.
Standard engagement structure
Unless otherwise agreed in writing, each project includes: (a) a one-time project fee for the design and build of agreed deliverables; and (b) a minimum 12-month maintenance retainer commencing on the delivery date, covering monitoring, minor updates, and support.
2. Fees & Payment
Project fees
Fees are set out in the SOW. Unless stated otherwise, a 50% deposit is due upon SOW signing, with the remaining 50% due upon delivery of the agreed deliverables.
Retainer fees
Monthly retainer fees are invoiced in advance at the start of each month and are due within 14 days of invoice date.
Late payment
Overdue invoices accrue interest at 1.5% per month (or the maximum rate permitted by Singapore law, whichever is lower). KYN reserves the right to suspend services for accounts more than 30 days overdue.
Taxes
All fees are exclusive of applicable taxes. Where KYN is required to collect Goods & Services Tax (GST) or any other tax, such amounts will be added to invoices.
3. Intellectual Property
Client ownership
Upon full payment of all fees due under a project, all intellectual property rights in the custom code, configurations, and deliverables created specifically for the Client vest absolutely in the Client. KYN assigns all such rights to the Client upon receipt of final payment.
KYN pre-existing IP
KYN retains ownership of its pre-existing tools, frameworks, libraries, methodologies, and general know-how ("KYN IP"). Where KYN IP is incorporated into Client deliverables, KYN grants the Client a perpetual, royalty-free, non-transferable licence to use that KYN IP solely as part of the delivered system.
Third-party components
Deliverables may incorporate open-source software or third-party APIs subject to their own licence terms. KYN will disclose material third-party components in the SOW or handover documentation.
4. Confidentiality
Each party agrees to keep confidential all non-public information disclosed by the other party in connection with the engagement ("Confidential Information"), and not to disclose it to third parties without prior written consent except:
- To employees or contractors who need it to perform the work, under equivalent obligations; or
- Where required by Singapore law or court order, with prompt prior notice to the other party where legally permissible.
Confidentiality obligations survive the termination of the engagement for a period of three (3) years.
5. Warranties & Limitation of Liability
KYN warranties
KYN warrants that services will be performed with reasonable skill and care and that deliverables will materially conform to the agreed SOW specifications at the time of handover.
Disclaimer
Except as expressly set out in these Terms, all warranties, conditions, and representations (whether express, implied, statutory, or otherwise) are excluded to the fullest extent permitted by Singapore law.
Limitation of liability
To the maximum extent permitted by law, KYN's aggregate liability to the Client under or in connection with any engagement shall not exceed the total fees paid by the Client to KYN in the three (3) months preceding the event giving rise to the claim. KYN is not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profit, data, or business opportunity.
6. Termination
By the Client
The Client may terminate a project engagement on 30 days' written notice. Fees for work completed up to the termination date, together with any non-recoverable third-party costs incurred, remain payable. The minimum 12-month retainer fee is non-refundable unless KYN is in material breach.
By KYN
KYN may terminate the engagement immediately on written notice if the Client: (a) fails to pay any invoice within 60 days of the due date; (b) commits a material breach that is not remedied within 14 days of notice; or (c) becomes insolvent or enters into liquidation.
Effect of termination
On termination, each party will return or destroy the other's Confidential Information. KYN will deliver to the Client all completed work product and source code produced up to the termination date, subject to receipt of outstanding fees.
7. Governing Law & Disputes
These Terms and any engagement with KYN are governed by the laws of Singapore. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved by good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to mediation before the Singapore Mediation Centre, and, if still unresolved, to the exclusive jurisdiction of the Singapore courts.
